1. Apple’s Standard EULA
The app is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to it. If they conflict, the Standard EULA controls to the extent Apple requires. Apple isn’t responsible for the app or its content and has no obligation to support it.
2. Using the app
We give you a personal, non-exclusive, non-transferable, revocable license to use ThemeFit on Apple devices you own or control, for personal, non-commercial use. The app is free to download and doesn’t require an account. Some content and features are part of Premium (section 3) or can be unlocked by watching an ad (section 5).
3. Premium subscription
ThemeFit Premium unlocks every wallpaper, Make your own template and widget style, and removes ads from the app. It is an auto-renewing weekly subscription bought through the App Store.
- Price. The price for your region, including any taxes, is shown in the app and on the App Store before you confirm.
- Payment. Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends.
- Renewal. The subscription renews automatically each week at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the current period ends.
- Cancelling. Manage or cancel the subscription in Settings > your name > Subscriptions on your iPhone. Cancelling stops the next renewal; you keep Premium until the end of the period you paid for. Deleting the app doesn’t cancel the subscription.
- Refunds. Apple handles refunds under its own policies. You can request one at reportaproblem.apple.com.
- Restoring. To use Premium on another iPhone or after reinstalling, sign in with the same Apple ID, open the Premium screen in ThemeFit and tap Restore Purchase.
- Family Sharing isn’t available for this subscription.
- Price changes. If the price changes, Apple will tell you in advance and, where required, ask for your agreement before charging the new price.
4. Free trial
New subscribers may be offered a free trial. Eligibility is decided by Apple, and the trial length is shown before you start. Unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription and your Apple ID is charged. Any unused part of a free trial ends when you buy a subscription.
5. Unlocking items with ads
Without Premium, you can unlock a premium wallpaper, template or widget style by watching a short ad. The item stays unlocked in the app on that iPhone without a time limit. Ad unlocks are free, aren’t purchases and can’t be transferred or restored: they are stored on your iPhone and are lost if you delete the app or move to a new iPhone. We may change which items can be unlocked this way.
6. Ads
The free version shows ads provided by third parties, including Google AdMob and its partners. We don’t control the products advertised, and anything you buy from an advertiser is between you and that advertiser. If you see an inappropriate ad, email us. Premium subscribers don’t see ads. How ads use data is explained in our Privacy Policy.
7. Our content
The wallpapers, widget designs, templates, stickers, backgrounds, graphics and text in the app (“Content”) belong to us or our licensors and are protected by copyright and other laws. You may use Content as wallpaper, in your own designs and in widgets on your own devices, for personal, non-commercial use. You may not:
- sell, sublicense, redistribute or publish Content, alone or as part of another product or collection;
- use Content commercially, including in advertising, merchandise or other apps;
- remove copyright notices or present Content as your own work.
The ThemeFit name, logo and app icon are our trademarks.
8. Your content
Photos you use in Make your own or the Photo widget, and the notes and countdowns you create, remain yours. They are processed and stored on your iPhone, as described in our Privacy Policy. Make sure you have the right to use any photo you add. If you send a report, you allow us to use it to review content and improve the app.
9. Acceptable use
You agree not to:
- use the app in a way that breaks the law or infringes other people’s rights;
- copy, modify, reverse-engineer or decompile the app, except where the law expressly allows it;
- interfere with the app or our servers, including by scraping or bulk downloading Content;
- get around ads, Premium or other access controls;
- send reports that are abusive, unlawful or deliberately misleading.
10. Weather and other services
Weather and air-quality data comes from a third-party provider. It is general information that may be inaccurate, late or unavailable, so don’t rely on it for safety decisions. Other features depend on Apple services, such as widgets, Photos, Calendar and place names, whose availability we don’t control.
11. Changes to the app
We may add, change or remove features and Content, including what is free and what is part of Premium, and we may suspend or discontinue the app. Widgets refresh on schedules set by iOS, which we can’t fully control.
12. Disclaimer
To the extent the law allows, the app and all Content are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the app will be uninterrupted or error-free. This doesn’t limit any rights you have as a consumer that can’t be excluded by agreement.
13. Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the app or inability to use it. Our total liability for any claim about the app is limited to the greater of the amount you paid for Premium in the 12 months before the claim and USD 50. Some places don’t allow these limits, so they may not apply to you.
14. Termination
Your license ends automatically if you break these terms. You can stop using the app at any time by deleting it; to stop paying for Premium, cancel the subscription as described in section 3.
15. Changes to these terms
We’ll post any update on this page and change the effective date at the top. If you keep using the app after a change takes effect, you accept the updated terms.
